Credit Terms

These Credit Terms explain how prepaid credits work on Escape Velocity: what they are, how you spend them, when they expire, and how refunds work. They are part of our Terms of Service, which they incorporate by reference; where these Credit Terms and the Terms of Service address the same subject, the Terms of Service govern. The purchase, tax, and payment mechanics for buying credits, and the merchant-of-record relationship, are set out in the Terms of Service.
1. What Credits Are
Credits are a prepaid balance, denominated in US dollars, that you buy in advance and draw down as you use the platform. They are a prepaid license to use our service - not legal tender, currency, a gift card, stored value, or a deposit. Credits have no cash value, are non-transferable, and are redeemable only for access to the platform, and they are not redeemable, refundable, or exchangeable for money except where a refund is expressly provided below or required by law.
When you buy credits, we charge your payment method for the amount you buy plus any applicable tax. How purchases, taxes, and the merchant-of-record relationship work is set out in our Terms of Service.
Only credits you have purchased are refundable. Promotional, bonus, or granted credits have no cash value and are never refundable.
2. How Credits Are Spent
We meter your use of the platform, including calls to third-party model providers, and draw the corresponding amount down from your credit balance in near real time. Our usage and metering records are the authoritative record of your usage and charges, absent manifest error.
Credits are consumed as you use the platform, including by agents you run. Consumed credits are final: they are not reversible or refundable. You are responsible for the usage your agents and API keys generate.
3. Automatic Top-Up
Automatic top-up is optional. If you enable it, you authorize us and our payment processor to store your payment method and to automatically charge it, without further action by you, to add credits whenever your available balance falls below a threshold you set. The amount charged is the top-up amount you configure, plus any applicable tax, and top-ups may occur as often as your usage requires.
You give this authorization when you enable automatic top-up, and you can change your threshold and amount, or turn it off, at any time in your account settings. We will give you notice before we change the terms of these automatic charges, and we keep a record of your authorization. Buying credits manually is always available; you never have to enable automatic charges.
4. Expiration
Credits expire twelve months after they are purchased. When credits expire, they are forfeited, cannot be used, and have no cash value. We recommend buying credits in amounts that match your expected usage.
5. Refunds
Consumed credits are final and are not refundable. Unused credits - credits you have purchased but not yet used - are refundable in the situations below, and are otherwise non-refundable except where required by law. We refund to your original payment method.
You can request a refund of an unused purchase within thirty days of buying it. And whenever you close your account, we refund the unused, paid credit balance remaining on it - if you leave, you take your unused balance with you. If we terminate your access without cause, or we discontinue the platform, we also refund your unused paid balance. If we terminate your access for your breach of the Terms, unused credits are forfeited, and credits that have already expired are not refundable.
We may decline or limit refunds we reasonably believe are fraudulent or abusive, such as repeated open-and-close cycling or payment testing.
